Big-Rig Accidents

At Gold Coast Law, we have personally witnessed the horrific aftermath of big-rig accidents.  These massive commercial vehicles can cause devastating injuries, even at low speeds.  Commercial vehicles are generally required to carry larger insurance policies.  Moreover, there can be major corporations liable for the damage caused by their vehicle and/or employees.  At Gold Coast Law, our first priority is always your health.  So, the worst news we ever have to give our clients is that there is not enough insurance coverage to allow them to get the medical treatment they need to recover from a major accident.  While we will always seek all options, such as personal health insurance or emergency Medi-Cal, there is a sense of relief when adequate coverage is assured.  With the benefits of large policies and corporate liability, also comes the self-interest of opposing parties trying to minimize their exposure.  This means that the responsible company and/or their insurance company will quickly attempt to improperly obtain information from you and search for a way to avoid responsibility for the injuries they caused.  This comes in many forms.  They can try to twist your own words against you in order to blame you for causing the accident.  They try to make it appear as if you were not injured or you did not need medical care.  They argue that your medical care was too expensive or excessive, and they are only responsible for paying a small portion of your bills.  The insurance industry has mastered the art of denial, delay and finding a way not to pay.  Don’t risk your physical and financial health by trying to deal with this on your own.  An experienced personal injury law firm will be there to protect you throughout the entire process.  That way, you can focus on your injury recovery and leave the rest to your attorney.  Best of all, it costs you nothing out of pocket to get the legal protection you need and deserve. Pedestrian v. Auto Accidents

When 4,000 pounds of metal hit a human body, it doesn’t take a medical expert to tell you that the results can be horrific.  After being hit by a car or truck, your injuries can be life altering, even at low speeds.  The only thing worse than the pain, can be discovering that the driver and/or police blamed you.  Whether you were in a crosswalk or jay walking, drivers have an obligation to watch for pedestrians and act reasonably to avoid such devastating collisions.  Many law firms shy away from representing accident victims when liability is unclear or disputed.  At Gold Coast Law, we are not afraid to take on these difficult cases.  In California, accident victims are entitled to compensation even if they were partially at fault for the accident.  We will fight to get you all of the compensation you deserve. Uninsured Motorist Claims

The first shock of an accident is usually the impact to your body.  Unfortunately, sometimes the next shock is finding out the at-fault driver did not have insurance.  While this may be an aggravating discovery, there is still hope.  Unbeknownst to many drivers, your insurance policy may contain Uninsured Motorist coverage.  This is an added protection that is included in many insurance policies, for events just as this.  When an uninsured person crashes with you, Uninsured Motorist coverages acts as if they were the insurance coverage for the at-fault party.  Your insurance company is supposed to compensate you for the damages caused by the uninsured driver and many times they have the right to attempt to collect reimbursement from the responsible driver.  Unless you were at fault for the collision or in cited for a traffic violation in relation to the accident, your premiums should not be affected by pursuing this type of claim through your own insurance.  Sadly, many accident victims soon realize that while insurance companies are quick to charge you for this coverage, they are very reluctant to pay your claim for the coverage you already purchased.  Your own insurance company quickly begins to treat you as an adversary rather than their own insured.  Unless you have an experienced attorney representing you, these claims are often denied or underpaid.  Don’t become a victim of your own insurance company’s greed.  Call us today a free consultation. 866-306-3011

Under Insured Motorist Claims

Ordinarily, California only requires drivers to carry liability insurance with coverage of $15,000 per person / $30,000 per accident.  Even in a moderate injury accident, your hospital bill alone can easily exceed the per person limit of $15,000.  This makes it extremely important to add Under Insured Motorist coverage to your insurance policy.  Many times, for a small additional fee, you can add Under Insured Motorist coverage to your auto insurance policy.  This added protection means that if you were involved in an accident and your damages exceed the at-fault driver’s available insurance coverage, your policy will cover you for the rest, up to your added coverage limits.  For example, assume that you have Under Insured Motorist coverage of $50,000 per person, you are hit by a person with the minimum $15,000 per person coverage and your total accident damages are $40,000.  In this scenario, you could collect the $15,000 from the at fault driver’s insurance company and then obtain the remaining $25,000 in compensation from your insurance company.  Obviously, this example is overly simplified.  The amount of your damages is often disputed.  Then after you convince the at-fault party’s insurance company to pay, then you have to fight twice as hard to get your under insured motorist coverage to pay for their portion.  Dealing with two insurance companies on your own can quickly become a nightmare.  Let our experienced legal team help.  Call us today for a free, no-risk consultation. 866-306-3011

*Damages is the legal term for the amount of harm suffered in an accident.  This may include, but is not limited to, related medical expenses, pain and suffering, property damage, and lost earnings.

Slip and Falls

Many times, falling in a store or public place can leave the victim not only with physical but also emotional pain.  Those injured in these types of accidents often experience embarrassment, shame and guilt for an accident that was not their fault.  Then, those that do find the courage to speak out, are often painted as frauds.  However, property and business owners have a clear legal duty to maintain their premises safe and resolve or notify patrons of dangerous conditions that can cause injury.  While the law is clear, the facts are frequently disputed.  Often, property owners will attempt to blame the victim by claiming that no one else fell or the victim should have seen the hazard.  If that fails, business/property owners then claim to have acted reasonably in meeting their duty to maintain the property safe and allege that they did not have sufficient notice to remedy the dangerous condition.  Making matters worse is the fact that, the property/business owners generally have sole access to much of the key evidence, such as surveillance video footage and inspection/maintenance documents.  These challenges cause many attorneys to refuse to take such cases.  At Gold Coast Law, we are up to the challenge.  We have successfully represented numerous clients who have been injured due to dangerous property conditions.  Call us today for a free consultation. 866-306-3011

Wrongful Death

There is no greater grief than losing a loved one in an accident caused by the carelessness of another person.  No amount of money can ever compensate you for your loss.  Unfortunately, the law usually leaves no other remedy than monetary damages.  While this remedy is imperfect, it does provide for a form of justice for your lost loved one, in addition to compensating you for your loss.  It also serves as a deterrent to the responsible party and others, which will hopefully prevent such a tragic event from occurring again. After such a loss, nothing is more revolting than when the person at fault and/or their insurance company refuses to take responsibility. We have seen insurance companies try unjustly lay blame on the deceased and attempt to diminish the value of our clients’ relationship with their lost loved one.  No one should have to deal with this during their time of mourning. Let our experienced and compassionate legal team help you during this difficult time.  Call us today for a free, no-risk consultation. 866-306-3011
